3. Independent Contractor Disclaimer and Separation of Entities

All contractors, waterproofing specialists, structural technicians, and tradespersons connected through our platform are separate, independent business entities and independent contractors.

  • No Employment or Agency Relationship: Nothing contained in these Terms or resulting from your use of this Site shall be construed to create an employer-employee, agency, partnership, joint venture, or franchise relationship between Cincinnati Foundation Repair Co (or Ground Level Growth) and any referred contractor.

  • Any claims, disputes, or losses resulting from contractor representations, warranties, verbal promises, or advertising materials.

Homeowner Responsibility for Due Diligence

You acknowledge and agree that foundation repair and structural remediation involve significant financial and physical modifications to real property. You are solely responsible for conducting all prudent due diligence before hiring, permitting work by, or issuing payment to any contractor. We strongly advise every homeowner to:

  1. Verify the contractor’s current state and local licensing status with the relevant municipal or state licensing board.
  2. Request and verify current Certificates of Insurance demonstrating active Commercial General Liability and Workers’ Compensation coverage.
  3. Determine whether required municipal building permits, engineering calculations, or zoning approvals have been secured prior to commencing structural excavation or underpinning.
  4. Obtain a written contract outlining the detailed scope of work, material specifications, payment milestones, and written warranty terms.

  5. ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR PERSONAL DATA.

IN ALL CIRCUMSTANCES, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR OUR REFERRAL SERVICES, UNDER ANY LEGAL THEORY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, STATUTORY VIOLATION, OR OTHERWISE), SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU TO Cincinnati Foundation Repair Co FOR ACCESSING THE SITE (IF ANY) OR ONE HUNDRED UNITED STATES DOLLARS ($100.00), WHICHEVER IS GREATER.

Mandatory Forum and Jurisdiction

Waiver of Class Actions and Jury Trial
